1. Our trade policy

1.1 The Vendor offers products for sale on equivalenza.com exclusively to end users who are "consumers" and only in relation to these carrying out its activities via e-commerce.

1.2 When we speak of "consumer" we mean any private individual acting within equivalenza.com for purposes other than those that pertain to commercial, business or professional activities that they may carry out. If you are not a "consumer", please refrain from carrying out commercial transactions on equivalenza.com.

1.3 Bearing in mind its own trade policy, the Seller reserves the right to reject orders placed by individuals who differ from the "consumer" or, in any case, the orders do not comply with the above trade policy.

1.4 These Terms and Conditions of Sale exclusively regulate the offer, acceptance of orders and shipping of equivalenza.com products between equivalenza.com users and the Seller.

1.5 The Terms and Conditions of Sale do not regulate, however, the provision of services or the sale of products by parties other than the Seller that are present in equivalenza.com through links, banners or other hyperlinks. 2. How to contract from EQUIVALENZA

2.1 To conclude the purchase contract of one or more products from equivalenza.com you have to fill out the order form that the Seller offers you electronically and send it back to the Seller electronically, following the specific instructions to that effect.

2.2 The order form contains a summary of the Terms and Conditions of Sale, in addition to a wide range of information about the essential characteristics of each product ordered, its respective price breakdown of taxes and other applicable costs, payment methods you can use to purchase each product, shipping methods for purchased products, shipping and delivery costs, the date on which the Seller agrees to deliver the product(s), the legal guarantee that can be applied to products, conditions relating to exercising your right of cancellation and the methods and terms of return of purchased products.

2.3 The contract shall be concluded when the Seller receives your order form electronically being, however, subject to verification of the accuracy of data relating to your order.

There will be no contract between us regarding any product until your order has been expressly accepted by the seller. If your purchase request is not accepted and your account has already been charged, the amount thereof will be refunded in full. To order, you must follow the online purchasing procedure and accept the terms and conditions of purchase.

2.4 Before buying the products, while sending the order form, you will be asked to carefully read the Terms and Conditions of Sale, Privacy Policy and the article on the Right of Cancellation, print a copy and save or print another for your personal use.

2.5 The order form will be filed in our database during the period of time necessary for the correct shipping of orders, and always within the limits established by law. You can access your order form at the My Order section.

2.6 Before sending the order form you will be asked to check and correct any mistakes in entering your data.

2.7 The language available for closing the contract with EQUIVALENZA is English.

2.8 Following the conclusion of the contract, the Seller will take charge of your order.

2.9 The Seller may decline to process orders that are incomplete or incorrect or if the products are not available.

On these occasions we will inform you by e-mail that the contract has not been concluded and that the Seller has not gone ahead with the order, properly specifying the reasons.

Should the products presented on equivalenza.com no longer be available or on sale at the time of your last access to the site, ie at the time of sending your order form, the Seller will be sure to let you know as quickly as possible the availability of the products that you have ordered.

If you had already sent the order form and paid the price of your order, the Seller shall reimburse the prepaid amount without any delay.

2.10 By sending the order form electronically you unconditionally accept these Terms and Conditions of Sale and the Privacy Policy and agree to observe them during your relationship with the Seller. If you do not agree with any of the terms mentioned in the Terms and Conditions of Sale, we ask you do not send the order form to purchase products on equivalenza.com.

2.11 By sending the order form you confirm that you understand and accept the Terms and Conditions of Sale and the rest of the information contained in equivalenza.com, including those points that are accessed through links, including the Terms and Conditions of Use and the Privacy Policy.

2.12 Once the contract is concluded, the Seller will send by email and within a period of between twenty-four and forty-eight (24/48) hours following the conclusion of said contract, a receipt of the order with a summary of the information in the order form, delivery note and invoice of your order.

2.13 We remind you that the item purchased is intended for the country in which you placed the order. So if you decide to transport the product to a different country, you will be considered solely responsible and will be subject to the obligation to follow applicable rules and import restrictions of the country where the purchase was made and export restrictions in the country of destination. EQUIVALENZA exempts itself from any responsibility.

2.14 The price of the products will be stipulated at all times on our website. Obviously, the price and other conditions of the items you have requested will not be modified during the period of time between the offer and the acceptance thereof issued by the shipping confirmation unless by law or decision by government agencies obliging us to make changes retroactively to those policies, Terms and Conditions or Privacy Statement, in which case the possible changes will also apply to previously placed orders. The prices displayed on the website are indicated in Euros, include both the possible discounts and the VAT applicable on the date of the order, but do not include shipping costs, which are listed separately on the Website.


3. Guarantees and information about the price of products

3.1 On equivalenza.com only first class perfume, cosmetic and air freshening products are put on sale. These products are purchased by the Seller directly from manufacturers and retailers carefully selected for their stringent quality controls.

3.2 The Seller does not sell products which are used, defective or of a lower quality than the equivalent market standard products.

3.3 The essential characteristics of the products are presented on equivalenza.com within each product sheet. Despite the scrupulous care taken by EQUIVALENZA in its faithful reproduction, the reality of the products, images and colours offered for sale on equivalenza.com, could, however, not be accurately reflected due to the specific characteristics of the Internet browser or screen used by the user.

3.4 The prices of products may be subject to updates. Ascertain which is the final sale price before sending the relevant order form.

3.5 Equivalenza.com only accepts purchase requests from the UK. Purchase requests from countries not included in this list should not be accepted by the Seller.

3.6 If you exercise your right of cancellation, the Seller has the right not to accept returned products without their original packaging, as well as products whose case or themselves have been opened, damaged or whose essential, qualitative characteristics have been altered.


4. Payments

4.1 To pay for the products and the respective shipping and delivery costs, you can choose one of the methods set out in the order form.

• Credit Card Payment: we accept payment by major credit cards (Visa, Mastercard, 4B). During the purchase process the bank with which we work (Banco Sabadell) will ask for three pieces of information; your card number, expiry date and security code or CVC2 (Card Verification Code).

• Payment by Secure Credit Card 3DSECURE (Visa, Mastercard, 4B, American Express) 3DSECURE: The new form of payment developed by Visa and MasterCard that permits secure purchases on the Internet and authenticates the buyer as the legitimate holder of the card being used. 4.2 If payment is made by credit card, bank details (for example, the number of your credit or debit card, or its expiry date) will be sent via a cryptogramatic protocol to Banc Sabadell or other banks, charged with providing the respective remote electronic payment services, without a third party being able to, in any case, have access to them. In addition such data will never be used by the Seller other than in order to complete procedures regarding your purchase, issue the corresponding refunds for any returns resulting from your right of cancellation and warn and inform the police if any fraud on equivalenza.com has been or could be committed.

The amount of the purchased products and shipping costs, as indicated in the order form, will be debited to your bank account, credit card or debit card, or PayPal account at the time of shipment of the products purchased.


5. Shipping and Delivery of products

5.1 Shipping costs are free for orders over 45 €. For orders less than 45 €, shipping costs are 3.5 €. We ship to the UK. Delivery of orders will be made to the specified address, once payment is confirmed, within 48/72 hours (Monday to Friday, excluding holidays) and depending on the stock available.

We ask you to pay attention to the text of that section, because the information contained therein is an integral and substantial part of these Terms and Conditions of Sale and shall be considered understood and accepted in full by you from the moment you send the order form.

7. Right of Cancellation

7.1 You have the right to terminate the contract with the Seller, without suffering any penalty and without having to explain the reasons, if you perform the termination within a period of fourteen (14) calendar days from the date you received the products purchased on equivalenza.com. The Seller shall confirm by a durable medium the exercising of your right of cancellation.

7.2 To exercise your right of cancellation, you must notify us of your decision to cancel the contract by a clear statement (eg a letter sent by mail, fax or email). You may use the model cancellation form below, although its use is not mandatory. To proceed with the termination of the contract you are welcome to use the cancellation document you can download here and send it attached to the email address customer@equivalenza.com, along with your contact details and order reference number.

7.3 In this case you must return the products to the Seller delivering them to the courier within a maximum period of fourteen (14) calendar days from the date on which you inform the Seller that you are going to exercise your right of cancellation.

7.4 The only expenses that you will have to pay will be the return of the products purchased, subject to what is stated in the following sections.

7.5 The right of cancellation - with respect to the terms and methods described in the preceding paragraphs 7.1, 7.2, 7.3 and 7.4 - shall be deemed correctly exercised if the following conditions have been met in full:

• Be sure to correctly fill out the cancellation document and send it by e-mail within fourteen (14) calendar days from the date of receipt of the products;

• The right of cancellation shall not apply to contracts relating to: 1) The supply of goods made to the consumer and user's specifications or that are clearly personalized. 2) The supply of goods that are liable to deteriorate or expire rapidly. 3) The supply of sealed goods which are not suitable for return for reasons of health or hygiene protection and which have been unsealed after delivery.

• The products must not have been used, nor the cases or products opened, tampered with or damaged;

• Products must be returned intact and unused in their original packaging (the packaging will still retain the original seal, if you want to return a kit, you must return all items that form part of it);

• The products to be returned must be issued to the Seller in a single shipment. The Seller reserves the right not to accept items belonging to a single order that have been sent for return at different times;

• Products to be returned must be delivered to the courier within a period of fourteen (14) calendar days from the date of receipt of the products;

7.6 Where the right of cancellation is exercised by following the procedures and terms set forth in this Article 7, the Seller shall reimburse any amounts that have been charged for the purchase of products in the manner and the terms provided.

7.7 The amounts will be refunded as soon as possible, and in any event, within fourteen (14) calendar days from the date the Seller was made aware of your desire to exercise your right of cancellation. As soon as it has been checked that the returns have been carried out correctly and respecting the terms and conditions listed above, we will activate the mechanisms for reimbursement, as described in Article 8 of these Terms and Conditions.

7.8 If your return does not meet the terms and conditions described in your right of cancellation, in accordance with the provisions of this article, you will not be entitled to any refund of amounts already paid to the Seller. You have the right to have returned from EQUIVALENZA the products in the conditions that you sent them, but the expenses will be borne by you. If you do not want the products returned, EQUIVALENZA can keep them together with the amount that would have already been paid.


8. Timing and procedures for reimbursement

8.1 After receiving the returned goods, the Seller will check them for compliance with the conditions and terms set out in Article 7. If the checks give a positive result, the Seller shall send, by email, the respective confirmation of the acceptance of the return of these products.

8.2 Whatever the payment method that has been used (credit / debit card or PayPal), the refund will be activated by the Seller as soon as possible and, in any event, no later than fourteen (14) calendar days from the date the Seller was made aware that you wanted to exercise your right of cancellation, but only after checking the proper exercise of your right and having accepted the return of the products.

8.3 If the recipient of the products indicated in the order form and the person who paid the corresponding sums for the purchase are not the same person, the repayment of sums caused by the exercise of the right of cancellation will be made by the Seller in relation to who made the payment.

8.4 For purchases by credit card or debit card, the date of payment of the refund will be the same as the debit, so you will not suffer any loss in terms of bank interest. For purchases through PayPal, the refund is credited to the PayPal account immediately after EQUIVALENZA accepts the return. The time until actual repayment on the credit card of your PayPal account depends on the issuer of the credit card.
